Yesterday the United States Senate voted 57-43 to acquit former president Donald Trump, after he was alleged to have incited the January 6 riot which saw some protesters enter the the US Capitol building.
The 57-43 vote was short of the two-thirds necessary to secure a conviction for “incitement of insurrection.”
Seven Republican senators defected and joined Democrats in voting for impeachment.
Trump released a statement welcoming the decision, and said that his movement “has only just begun.”
After initially pushing to call witnesses for deposition or cross examination, Democrats quickly backed down after Trump’s defense lawyer said that they would also be calling “at least 100 witnesses, including Speaker Pelosi and Vice President Harris.”
Democrat House Managers led by Jamie Raskin ended up only admitting a single witness statement from GOP Rep. Herrera Beutler into the trial record – a secondhand account of an alleged damning phone call between former president Trump and House GOP leader Kevin McCarthy on January 6 where Trump supposedly rebuffed McCarthy’s plea to the President to call off the protests.
No Due Process
It marks the second time in 12 months that Trump has been acquitted by the Senate after House Democrats brought impeachment charges. In both cases, Democrats failed to make a coherent case, and in this latest impeachment attempt they were seen to have completely abrogated any due process. Patrick Philbin, a member of President Donald Trump’s legal team, said the president was not given due process during the House impeachment inquiry, and that he was “locked out” of nearly all parts of the investigation. “The process was never about finding the truth. The process was about achieving a predetermined outcome on a timetable, and having it done by Christmas,” said Philbin.
The failure to bring a proper case to the Senate resulted in the rapid collapse of their case over the weekend. Critics of House Democrats have said this is more proof that this impeachment was yet another political “show trial.”
