According to Trump’s order dated February 6, 2025, the International Criminal Court (ICC)’s “malign conduct” threatens “the sovereignty of the United States and undermines the critical national security and foreign policy work of the United States government.” The order alleges that the ICC is engaging in actions that are both illegitimate and unfounded, specifically aimed at the United States and its close ally, Israel and its Prime Minister Benjamin Netanyahu and his former defense chief Yoav Gallant. The United States contends that the court lacks jurisdiction over Israel. Ironically, the US was fully supportive of the ICC in 2023 when it indicted officials from another non-member – Russian President Vladimir Putin and and Russian commissioner for children’s rights, Maria Lvova-Belova, alleging for the war crime of unlawful deportation and transfer of children during the Ukraine conflict – allegations which have since proven to have been completely fabricated. Trump’s order issued in February prohibits ICC Chief Prosecutor Karim Khan, and other non-American individuals among the 900 staff members of the ICC – from entering the United States which is not a signatory to the court. Additionally, it imposes penalties, including fines and imprisonment, on any individual, organisation, or corporation that offers Khan any form of assistance. But Trump didn’t stop there…
As a result of these sanctions, ICC Chief Prosecutor Karim Khan’s Microsoft email account has now been disabled, and his UK bank accounts have been frozen. Several Human rights organisations based in the United States have announced the cessation of their collaboration with the International Criminal Court (ICC), indicating they are now deliberately refraining from engaging with court representatives due to concerns over potential governmental reprisals. Coincidentally, in the weeks leading up to Khan’s announcement regarding his request for arrest warrants for Israeli leaders Netanyahu and Gallant, dubious reports of sexual harassment strangely started to emerge, as reported by the Associated Press. Khan has categorically denied the accusations. Interestingly, it isn’t the first time the ICC has upset Trump. In 2020, the Trump administration sanctioned Khan’s predecessor, Fatou Bensouda, and a deputy over the court’s investigation into alleged offenses in Afghanistan during the U.S. military’s presence in the country.
On April 24, 2025, the ICC Pre-Trial Chamber rejected Israel’s jurisdictional challenge regarding the court’s jurisdictional standing, effectively barring the Hebrew State from pursuing further appeals or efforts to invalidate or suspend the arrest warrants issued for two Israeli officials. At the time, Khan was also organising a new set of applications concerning Israeli individuals implicated in purported war crimes and crimes against humanity within the occupied Palestinian territories. Surprisingly, Khan was advised to remain quiet about any future warrants related to Israel’s war crimes. Microsoft is facing growing criticism for suspending the email account of the ICC Chief Prosecutor, an action that has significantly hindered the Court’s operations, given its reliance on service providers like Microsoft.

Recent warnings from the UK’s Foreign, Commonwealth & Development Office to individuals such as Lord Justice Adrian Fulford, Baroness Helena Kennedy, and barrister Danny Friedman—cautioning them about potential U.S. sanctions for their advisory roles in the ICC case against Israeli officials—reveal new and troubling dimensions of this confrontation. This action threatens not only the independence of international judicial institutions but also has far-reaching implications for global justice, international cooperation, and the rule of law.
Since its founding in 2002, the ICC—tasked with prosecuting war crimes, crimes against humanity, and genocide—has faced political challenges. The United States, which never joined the Court, has maintained a hostile stance from the beginning. During Trump’s first term, this hostility intensified with sanctions against ICC officials, including then-Prosecutor Fatou Bensouda. Trump’s war on the ICC carries significant ramifications for international relations. First, it risks damaging U.S. ties with key allies like the United Kingdom. The UK Foreign Office’s warning to British lawyers reflects London’s deep concern over Washington’s actions. Such tensions could strain bilateral cooperation in legal, diplomatic, and even military arenas. Second, the sanctions tarnish the United States’ credibility as a champion of human rights and the rule of law. While the U.S. proclaims itself a global leader in democracy and justice, threatening independent lawyers for collaborating with an international court exposes a fundamental hypocrisy. This could embolden other states—especially those with records of human rights violations—to ignore the Court’s rulings. Third, this move risks undermining global cooperation with the ICC. If leading jurists are punished for offering legal opinions, incentives to assist the Court will diminish. Furthermore, Trump’s aggressive stance toward international institutions is part of a broader strategy to challenge the multilateral global order. The ICC, as a symbol of international cooperation, is an easy target for this ideology. By weakening the Court, Trump advances a narrative that prioritises national power over international law.
The world cannot remain silent in the face of this attack on global justice. ICC member states—especially U.S. allies like the UK—must publicly condemn these sanctions and defend the Court’s independence. International legal bodies, such as global bar associations, should issue statements in support of the threatened lawyers. Civil society and the media also play a vital role in exposing these actions and raising public awareness. Public pressure can compel governments to take a stronger stand against such threats. Ultimately, the ICC itself must continue its investigations and issue fair rulings to demonstrate its resilience against political intimidation.
